Thank you for trusting Opal with your information. These Privacy Policies are intended to help you understand what data we collect, what we do with it, and why we do so. Please read this document carefully. You can find controls to manage your information and protect your privacy and security in your account settings.
1. Information We Collect
We collect information to provide better services to our users and our future users—things like (but not limited to) the way you interact with our user-interface, the types of data you upload, the types of data you share, and the personal connections you make with other users.
We collect information in the following manners:
1.1 Information You Give Us
All of our services require you to sign up for an Opal Account. When you do, we ask for personal information, like your name, email addresses, telephone numbers, organization name, title, addresses, and credit card number to store with your Account. To take full advantage of our services, you may also upload a profile image, and if that is a picture of you, then we will also retain the image to better serve you and other users.
1.2 Information We Derive from Your Use of Opal
We collect information about the services that you use and how you use them, such as when you upload a file, when you link to an outside website to create a bookmark, when you share information with another user, and so on. Furthermore, information we collect when you are signed in to Opal may be associated with your Opal Account.
This information includes:
1.2.1 Device Information
We collect device-specific information (such as your hardware model, operating system version, unique device identifiers, and mobile network information including phone number). Opal may associate your device identifiers or phone number with your Opal Account.
1.2.2 Application Identifiers
When you use our services, we may collect and process information about your present location, to whatever granularity or specificity your device and the access point or cell tower through which it connects to the internet. We may use various technologies to determine or interpolate your location.
1.2.3 Log Information
When you use our services or view content provided by you or Opal, we automatically collect and store certain information in server logs. This includes:
- Details about how you used our service, such as your search queries, the content types you used or created, etc.;
- Internet protocol address;
- Device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL; and/or
- Cookies that may uniquely identify your browser.
1.2.4 Location Information
When you use Opal, we may collect and process information about your actual location, using technologies such as your IP address, GPS, and other sensors, which may provide Opal with information on nearby devices, wi-fi access points, and cell towers.
1.2.5 Local Storage
We may collect and store information (including personal information) locally on your device using mechanisms such as browser web storage (including via HTML 5), application data caches, and browser-side encryption protocols.
1.2.6 Cookies and Such
We use various technologies to collect and store information when you use Opal, including cookies or similar technologies to identify your browser or device.
2. How We Use Information We Collect
We use the information we collect from our services to provide, maintain, protect and improve them, to develop new ones, and to protect Opal and our users. We may also use this information in the future to offer you content tailored to your needs.
We will use the name you provide for your Opal profile across all of the services we offer. If other users already have your email, or other information that identifies you, we may show them your name, photo, and email address.
When you contact Opal, we keep a record of your communication to help solve any issues you might be facing. We may use your email address to inform you about our services, such as letting you know about upcoming changes or improvements.
Opal processes personal information on various servers, which may reside in several countries around the world. We may process your personal information on a server located outside the country where you live.
3. Transparency and Choice
Opal Users and others may have different concerns about privacy. You can make your own meaningful choices about the information we collect. For example, you can:
- Adjust your profile to determine how it displays to other users;
- Opal who you share information with based on the sharing features of each item you create in Opal;
- If you pay for the added service, encrypt your data in our database, subject to our Terms of Service;
- Designate items you create or copies of items shared with you for deletion, which shall be deleted from our servers after a reasonable period of time; and/or
- Block all cookies set by Opal, bearing in mind that some or all of our services may not function properly or at all if you do so.
4. Accessing and Updating Your Personal Information
We purpose to provide you with access to your personal information. If it is wrong in our database, we will strive to give you ways to update or remove it quickly, unless we are required to keep such information for legitimate legal purposes or unless we reasonably desire to keep such information for ongoing legitimate business purposes. We may ask you to verify your identity before we act on your request.
We will reject requests that are unreasonably repetitive, would require disproportionate engineering or technical effort, would risk the privacy of others, or would be impracticable.
Where we can provide information access and correction, we will do so without charge unless it would require a disproportionate effort.
5. Backup Copies
Because we maintain our system with the purpose of protecting against malicious or accidental destruction, after you delete information from our services, we may not immediately delete residual copies from our active services and may not remove information from our backup systems.
6. Information We Share
We do not share personal information with third parties outside of Opal, except in the following circumstances:
6.1 When You Consent to Disclosure
We may share personal information with third parties when you affirmatively consent to do so.
6.2 External Processing
We provide personal information to affiliates or trusted businesses or persons to process it, based on appropriate confidentiality and security measures. For example, we will share as much of your information as is necessary to process payments for your Subscriptions to Opal.
6.3 Legal Reasons
We will share personal information with third parties if we have a good-faith belief that access, use, preservation, or disclosure of the information is reasonably necessary to:
- Comply with any applicable law, regulation, due legal process, or enforceable governmental request;
- Enforce applicable Terms of Service, including investigation of potential violations;
- Detect, prevent, mitigate, or otherwise confront fraud, security, or technical issues; or
- Protect against harm to the rights, property, or safety of Opal, our users, or the public, each or all as required or permitted by law.
6.4 Anonymized Information
We may share non-personally identifiable information publicly and with our partners.
6.5 In Case of Merger, Acquisition, or Sale
If Opal is involved in a merger, acquisition or sale, we will continue to ensure the confidentiality of any personal information and given affected users notice before such personal information is transferred or becomes subject to different privacy policies.
7. Information Security
We work fastidiously to protect Opal and our users from unauthorized access to or unauthorized alteration, disclosure, or destruction of information we hold. Specifically:
- We provide our main Service using SSL;
- We review our information collection, storage, and processing practices to guard against unauthorized access to systems; and
- We restrict access to personal information to Opal principals, employees, contractors, and agents who need to know the information in order to process it for us.
8. Application of Privacy Policies
These Privacy Policies applies to all services offered by Opal, except to services we offer which expressly do not incorporate these policies and incorporate different privacy policies.
These Privacy Policies do not apply to services offered by third parties.
9. Modifications to Privacy Policies
We may modify our Privacy Policies from time to time. We will not reduce your rights under these Privacy Policies without your consent. However, if you do not consent to further modifications of our Privacy Policies as we may make from time to time, we may terminate our provision of Services to you, or terminate your Opal Account, or both.
