This policy lists Opal’s requirements for notice of copyright infringement and for responses to such a notice if you or your materials are accused of infringement. This policy follows the procedures of the Digital Millennium Copyright Act.
1. Notice of Copyright Infringement
To notify Opal of copyright infringement, please send a written communication to copyright@opalrecall.com to or 598 Pine Valley Road, Bayfield, CO 81122. Your communication must include the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
- Identification of the copyrighted work you claimed has been infringed or a representative list of infringed works if such a list can ascertainably identify the class of such works;
- Identification of the material that you claim infringes the work(s) identified in(2) and which you are seeking to have removed or disabled, along with information reasonably sufficient to permit us to locate the material;
- Information reasonably sufficient to permit us to contact you or the complaining party if you are writing on the complaining party’s behalf, such as an address, telephone number, and, if available, an email address at which the complaining party may be contacted;
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. This statement is absolutely required for your request to be honored; and
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. This statement is absolutely required for your request to be honored.
2. Counter-Notice
If you are an Opal user and we have taken down your materials due to suspicion of copyright infringement, you may dispute the alleged infringement by sending a written communication to us at copyright@opalrecall.com or 598 Pine Valley Road, Bayfield, CO 81122. Your communication must include the following:
- A physical or electronic signature of a person authorized to act on behalf of the person who disputes the alleged infringement;
- Identification of the material that we have removed or for which we have disabled access and the location at which the material appeared before removal or before it was disabled;
- A statement under penalty of perjury that the person disputing the infringement has a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- The name, address, telephone number, and email address of the person disputing the alleged infringement; and
- A statement that the person disputing the alleged infringement consents to the jurisdiction of the United States District Court for the judicial district in which this person’s physical address is located, or if the person’s address is outside the United States, the United States District Court for the District of Wyoming, and that the person will accept service of process from the person who provided notification to us of the alleged copyright infringement or that person’s agent.
3. Repeat Infringement
Opal will, in appropriate circumstances, terminate the Accounts of users who repeatedly infringe on others’ copyright.
4. Revisions
We may revise this policy at any time.
